Michael Hernandez Will Go To Trial September 8th

He's Pleaded Not Guilty By Reason Of Insanity

MIAMI (CBS4) ― Lawyers for a Miami-Dade teen accused of stabbing a classmate to death four years ago have turned down a plea deal offered by prosecutors on Tuesday.

Michael Hernandez, 18, faces life in prison without parole if he's convicted in killing of classmate 14-year-old Jaime Gough in the bathroom of Southwood Middle School in 2004.

Michael Hernandez's defense team had been seeking a prison term of no more than 30 years. On Tuesday prosecutors countered with a 40 year term. When the two sides couldn't come to an agreement, Hernandez's attorney rejected the deal and said they would take their case to trial.

Earlier this year, the judge in the case ruled that the trial would be moved out of Miami because of all the publicity surrounding it.  Hernandez's trial in Orlando is scheduled to begin on September 8th.

Gough had more than 40 stab wounds to his neck, face and hands when he was killed. Hernandez, who was also 14 at the time, reportedly confessed to the murder in a videotaped statement. He has since pleaded not guilty due to insanity.
