Bond Denied For UM Student Accused Of Attack
MIAMI (CBS4) ―
A judge denied bond Wednesday to a University of Miami student who fought in the War in Iraq and even received a military scholarship, after updating his charges to battery and kidnapping on Wednesday.
The Judge said, "If you want to me to read what he is alleged to have done, I would say that would terrorize me, so I'm finding probable cause for kidnapping- no bond."
CBS4 News learned that 26-year-old Wascar Payano was arrested Tuesday for allegedly attacking a woman, but this is apparently not the first time Payano faces such accusations.
At least three different women, from U.M. and the University of Toledo in Ohio have filed police reports, accusing Payano of menacing and trespassing.
Coral Gables Police say the incident for which he is being charged happened on January 22nd. That's when they say Payano was spending time with a group of girls in his condo at the Village of Merrick Park. Detectives say Payano pinned a girl to a bed, touched her sexually, spanked her repeatedly and refused to let her leave, despite her and her friend repeatedly yelling for him to stop.
Payano tried to speak to the judge, telling him he is a University Miami student, but the Judge cut him off, saying, "Well you know what, that doesn't matter. You're not getting out."
CBS4 News learned Payano is being investigated for the two other alleged incidents, but hasn't been officially charged. One is a battery case in December in another Coral Gables condominium, and a trespassing case involving a UM freshman who says Payano is dating her friend. That freshman says she's so intimidated by him she doesn't want her name revealed.
The student filed a police report, and said Payano was banned from freshman dorms at UM after he crept into her dorm room at 4:30 a.m. last September while she was sleeping and tried to crawl into her bed.
The student says, "I woke up to someone kind of pulling the covers off of me from the bed, and I only had a T-shirt on, so I freaked out. He crawled backward out of the room and tried to like sneak out."
She goes on to say, "I just felt like really violated. We were all scared, we were all freaking out. We got our locks changed right away."
She also says other female students have also had creepy encounters with Payano.
"Girls felt uncomfortable, they felt violated, he touched them when they didn't want to be touched."
CBS4's Natalia Zea spoke with Payano's girlfriend who is also a student at U.M. She says Payano is a good man, and that the girl making this recent allegation is blowing it all out of proportion. She also says the student who accuses Payano of entering her dorm room in the middle of the night did not see his face, she says that student has the wrong man.
Payano has not been charged in any other case. He's only charged in the January 22nd incident involving the girl at his condo. He will remain locked up until his arraignment in three weeks.
