Pistol Packin' Pappy Shoots Suspected Thief

MIAMI (CBS4) ― A pistol packin' Miami senior citizen foiled a robbery attempt on his son's car.

Miami Police said the incident began when the would be 20-year old thief, identified as Norberto Fernandez, tried to break into a Honda Accord parked in front of a home in the 13-hundred block of Southwest 14th Street.
 
The car's owner, Jorge Pedro Jauregui, saw what was happening and ran out to his car.  He reportedly told Fernandez he was armed and ordered him out of the car.

The two men allegedly got into a scuffle and that's when the Jauregui's father, 85-year old Jorge Florentino Jauregui, got a gun and shot Fernandez.


"This was a nasty fight where both of them were taken down to the ground, "Willie Moreno of Miami Police told CBS4's Peter D'Oench.

He was rushed to Jackson Memorial Hospital in critical condition.

The elder Jauregui, who was a police officer in Cuba before the Castro regime, reportedly told police he felt forced to fire because he believed his son's life was in danger.

"You definitely cannot discharge your firearm to protect a property, but definitely you can discharge a firearm to protect the death, or bodily injury, of another one," said Miami Police spokesman Willie Moreno, "and this might have possibly been that case."

Jorge Jauregui,50, believes his father did the right thing.

"When you have a situation, you never know what you are going to do," said Jauregui, "but I think, in that moment, that is what he felt he needed to do, he felt that my life was in danger, his son's life was in danger."

Police believe Fernandez was also involved in purse snatching in the neighborhood about a half an hour before he was shot. 

Nno word on whether charges will be filed against the elder Jauregui.

Fernandez has been charged with with burglary to a motor vehicle, aggravated assault and battery, police said.
