New Judge Takes Over Marlins Stadium Lawsuit

City And County Approved Miami Marlins Stadium

Stadium said to cost around $515 million

MIAMI (CBS4) ― There's a status hearing scheduled Friday for all parties involved in the Florida Marlins' ballpark lawsuit.

That's because the judge who was originally on the case stepped down due to a conflict of interest. Miami-Dade Circuit Court Judge Pedro Echarte Jr. discovered he's a distant relative of one of the plaintiff's attorneys.

The new judge, Jeri Beth Cohen, scheduled a hearing Friday to catch up on the case in which auto dealer Norman Braman filed a lawsuit seeking to block a multibillion dollar-plan to build a new stadium, construct a port tunnel, and shift funds for the Adrienne Arsht Center for the Performing Arts.

The mega-plan's overall funding agreement was approved in December by the elected officials of the city and county and the CRA and it included approval to build the $515-million dollar retractable-roof stadium for the Marlins.

Braman has sued the City of Miami, Miami-Dade County and the Marlins, alleging that the funding for the mega-plan was done illegally by not allowing residents to vote on the issue. Government officials deny the allegations.

The trial was originally scheduled to begin July 1 but has been postponed.
