Divorce Centers On Who Should Get Wife's Nude Pics
CASSELBERRY (CBS4) ―
A legal battle over a wife's nude photographs is underway in a courtroom near Orlando. One divorce attorney weighing in on the issue says the problem is more common than one might think.
Valeria Gentile said her soon-to-be ex Erwin Cajamarca distributed nude pictures on a Spanish-language porn site. She alleges he distributed them via the Internet and used them on online sex chats.
So, when Gentile found out she said she felt humiliated and she's now suing him. She claims the incident humiliated her and she calls it cruel and an invasion of privacy, according to her lawsuit. Now, thousands may have been watching as she posed sexually in pictures meant only for her husband, and not for an audience.
She wants money to help repair the damage. The lawsuit did not specify an amount, according to the Orlando Sentinel.
Meanwhile, her hubby is mum on the whole dispute, but says his wife knew he had been posting some of her nude photographs.
But one divorce attorney said the photographs legally belong to both of them. Often times, the wives are willing to give up other precious possessions when negotiating the division of assets.
"The husband will get the picture of the dog, the cat and the house and wedding photos, and the wife will get the other photos," said Mitchel B. Krause, an attorney in Central Florida, told the newspaper.
Meanwhile, her lawyer said her hubby should have shredded them.
The couple continued to live under the same roof until last week, her attorney Frank T. Allen said. They filed for divorce in April and had been married for seven years.
