Retired New York Yankee player James Leyritz will stand trial this fall for a deadly DUI accident.
During a hearing Thursday morning Circuit Marc Gold informed the ex-major league slugger and his attorneys that the case would go to trial September 14th. He also set a future hearing date to discuss an alcohol monitoring device that malfunctioned last week in Leyritz car.
Last week, the monitoring device showed Leyritz had alcohol in his system. Two urine tests, however, contradicted the machine's results. At a hearing last Friday, Circuit Judge Marc Gold agreed that the machine had malfunctioned and Leyritz would not face any penalty.
As a condition of his release, the breathalyzer device in Leyritz's car is supposed to monitor him for alcohol when he's behind the wheel. He must blow in it to start the car, and periodically while driving.
Leyritz is accused of driving drunk in 2007 when he struck and killed a woman in Ft. Lauderdale.
