Joe Cool wants statements he made to the FBI and Coast Guard excluded from his trial.
Wednesday, defense attorneys for Guillermo Zarabozo, 20, will present their case to federal Judge Paul Huck. Zarabozo has pleaded not guilty in the murders of
Joe Cool's captain Jake Branam, his wife Kelly, and crew members Scott Gamble and Samuel Kairy.
Last month, co-defendant Kirby Archer, 36, accepted a plea deal from prosecutors. In exchange for pleading guilty he would not face a death penalty. Archer will be sentenced October, 2nd.
In his plea agreement with federal prosecutors, Archer admits to participating in the murders of the
Joe Cool crew. He admits to having shot and killed the Branams, but says Zarabozo killed Gamble and Kairy.
Zarabozo's attorneys want Judge Huck to allow him to use lie detector evidence to back up his claim that he didn't kill anyone. Zarabozo blames the murders entirely Archer.
The two men originally hired the 'Joe Cool' charter boat to go to the Bahamas, and then tried to divert it to Cuba. When the crew refused, they were shot, killed and dumped overboard. The bodies were never recovered.
Zarabozo is scheduled to stand trial September 22nd.
