Child Only Suffered Some Scratches

Police: It Was An Accident, No Charges Will Be Filed

MIRAMAR (CBS4) ― A fearless 4-year old is lucky to be alive after jumping off a second floor balcony at a Miramar apartment complex.

According to the Ruth Torres, the child's grandmother, she was in the shower Thursday morning when her grandson, Dayshawn Carias, wandered out onto her apartment's balcony, pushed a chair up to the railing and jumped. The boy fell 20 feet before landing in some bushes; narrowly missing a concrete sidewalk inches away.

The boy then wandered about a half a mile away until he was found by a good Samaritan in the 33-hundred block of 160th Avenue; she called police. 

"I say he must have fallen and on top of the bushes, because I saw he had some scratches," said Torres. "I was very worried."

Miramar Police spokesman Bill Robertson said Carias, who was dirty and a little banged up from landing in the bushes, was taken to a hospital where he was treated for minor cuts. He was then placed into the custody of the Department of Children and Families until his parents could be found. According to police, Torres was named legal guardian of the child when the boy's mother was sent to jail.  She told police she was shocked when she found out what happened.

"I didn't think he would do that.  I wouldn't even let him come out, outside on the balcony," said Torres.

Thursday afternoon Torres was reunited with her grandson.

Police said Torres will not face any charges and have ruled the incident an accident.

She says she plans on putting a lock on her balcony door to prevent any more similar incidents.
