Charges Dropped Against 13-Year-Old In Rape Case

MIAMI (CBS4) ― A 13-year-old who was arrested and accused of rape in Miami has been cleared of charges, less than 24 hours after Miami police announced his arrest.

Police say the victim had just said goodbye to her husband when she heard a knock at the door. She remembered the door was unlocked. When she went to check it, Miami Police say the teens attacked her and ransacked her home.

That's when police say the 13-year-old--whose name we are no longer publishing because he's a minor--and 15-year-old Carlos Rivero brutalized the woman, who was at home caring for an infant and a toddler.

"They tortured her. They terrorized her," said Officer Kenia Alfonso.

In their original news release, Miami police say the teens walked into her house, apparently at random through an unlocked door. They Tasered the woman and raped her while her infant child slept in a nearby room.

"It is shocking to us because it is not something that we see all the time--especially that they're armed with a Taser," said Alfonso.

Rivero appeared in court Thursday. Both teens had originally been charged with armed sexual battery, armed burglary, kidnapping, and armed robbery. The home was also ransacked and cash and other items were stolen. Police had said both teens confessed.

Charges were dropped against the 13-year-old, but Rivero still faces the charges.

Police say Rivero, and a third suspect forced the young mother to beg for her life, and the lives of her children.

"It's unbelievable and it's sad because she's going to live with this for the rest of her life."

Miami Police say they have not been able to bring charges against the third person at this time. They believe he is also a juvenile.

CBS4 News is still identifying Rivero--despite being a minor--because of the heinous nature of the charges.
