  The PHOENIX PROJECT Contest (as amended)


NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  THE CONTEST IS VOID WHERE PROHIBITED BY LAW.


1.    How to Enter the Contest:

(a)    The PHOENIX PROJECT will begin on Tuesday, June 15th, 2009 at 9a and end on Saturday, July 4, 2009 at 5p.  The contest is sponsored by Dade County Federal Credit Union, Guillermo Perez, Attorneys at Law, Shino Bay Dermatology, Best Smile and Dr. Melvin Propis, Cosmetic Surgeon.

(b)    To participate in the contest, go to cbs4.com/phoenix to complete an online application which includes an original essay requirement detailing why applicant should be picked for The Phoenix Project.

(c)    You must be 21 years of age  or older to enter. Some or all of the following must apply to you:  You must be out of shape; your home in or near foreclosure; you need dental care; and/or you are  in need of a lifestyle change.  You must be healthy enough to participate in a rigorous exercise program, and must be free of any physical limitations, medical ailments, physical or mental conditions that would limit or prevent you from participating in the Phoenix Project. You must have access to a computer at home and must have transportation available to travel to the CBS4 television station and sponsor service providers on an as needed basis.

(d)    Sponsor is not responsible for technical or computer failures, errors or data loss of any kind, lost or unavailable Internet connections, or failed, incomplete, garbled or deleted computer or network transmissions, inability to access any Web site or on-line service, or any other error or malfunction, or late, lost, illegible or misdirected entries. Entry materials that have been tampered with or altered are void. If the judges determine, in their sole discretion, that there is any suspected or actual electronic tampering with the Contest or if technical difficulties compromise the integrity of the Contest, the judges reserve the right to void the entries at issue and/or terminate the Contest and conduct a random drawing to award the prize among all eligible entries received as of the termination date. If the Contest is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted at www.cbs4.com. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. Sponsor reserves the right to disqualify any entrant that tampers with the operation of the Contest or website or violates the Official Rules of the Contest.

    By use of this website and by entering the Contest, you agree to the Station's Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at:  www.cbs4.com.

(f)    Entry deemed made by holder of e-mail account.

(g)    Odds of winning depend on number of eligible entries.

2.    Eligibility Restrictions:

(a)    The contest is open to Broward and Dade County residents who are 21 years of age or older.  Employees of WFOR, WBFS, CBS Corporation, Dade County Credit Union, Shino Bay Dermatology, Guillermo Perez, Attorneys at Law, Best Smile, Dr. Melvin M. Propis staff, other television and radio stations in the Miami market, and their affiliates, subsidiaries and advertising agencies and their immediate family members and persons living in the same household are ineligible to participate or win.

(b)    Viewers are eligible to win a WFOR contest only once every sixty days.  Only one winner per household is permitted in any contest. Viewers are eligible to win a prize valued at $600.00 or more only once every six months.

(c)    All entries become the sole property of Station and will not be returned.  By entering, entrants agree to abide by these rules, and warrant and represent that their entry is their original work.

(d)    Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent.  The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any entry received from persons under the age of 13.


3.    Prizes will include but are not limited to:

(a)    Dade County Credit Union: Financial services including analysis of credit issues and assistance in clearing up winner's credit report, if necessary, in the sole judgment of the Dade County Credit Union.  A $500 CD 12-18 month Certificate of Deposit will be made in winner's name.  Prize Value:  $500
(b)     Guillermo Perez, Attorneys at Law: Loan restructuring on property and foreclosure defense, if necessary, in the sole judgment of the Guillermo Perez, Attorneys at Law.  Prize value: $2,500-$6,000
(c)     Shino Bay Dermatology: Laser treatments, botox, fillers and other dermatological services as may be needed by the individual, if necessary, in the sole judgment of Shino Bay Dermatology. $4,000-$11,000
(d)     Best Smile: Complete evaluation with upper and lower veneers, if necessary, in the sole judgment of Best Smile.  Prize value:  approximately $20,000.
(e)    Dr. Melvin Propis, Cosmetic Surgeon:  Breast augmentation or other cosmetic surgery, if necessary, in the sole judgment of the Dr. Melvin Propis, Cosmetic Surgeon.  Prize Value:  $5,500-$7,500


(c)    All prizes or prize certificates may be picked up at the office of WFOR, 8900 NW 18th Terrace, Miami, FL 33172.  Any prize or prize certificate not claimed within thirty (30) days of winning will be forfeited by the winner.  In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its arrival.  WFOR is not responsible for the safe arrival of a prize or prize certificate.  

(d)    Contest prizes are not transferable.  Prizes may not be substituted for or redeemed for cash.  Station reserves the right to substitute prize of comparable value.

4.    Selection of Winners:

(a)    On Monday, July 6th, 2009 the Phoenix Project staff will narrow the entries down to 12 finalists based on their essay.  (1) Writing that indicates good communication skills (20%). (2) details indicating that the entrant needs and is desirous of the prizes/services being awarded (50%). (3) Conveyance of enthusiasm and desire to participate and follow through on the make-over (30%).
(b)    On Wednesday, July 8th 2009 the Phoenix Project staff along with the participating sponsors will further narrow the field of 12 down to 4 finalists based on in-person interviews at the WFOR station at 8900 NW 18th Terrance in Doral, FL. Criteria are (1) Good communication skills (40%)(2) poise in discussing their feelings and needs in front of the cameras/group (40%) (3) ability to complete services in 16 weeks (20%).
(c)    On Monday, July 13 , 2009 the six finalists will be presented to the viewing public for online voting at www.cbs4.com/phoenix.
(d)    Contest ends on July 19th at 11:59pm.  Winner is determined by popular vote (49%) and by a final review of candidates by the Phoenix Project staff and the participating sponsors (51%).
(e)    In the event of a tie, a coin will be tossed to determine the winner.


5.    Conditions:

(a)    Payment of all federal, state and local taxes are the sole responsibility of the winner and winners may receive an IRS Form 1099 or equivalent from Station.

•    (b)    By participating in the contest, the winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest, and to sign a publicity release, affidavit of eligibility and release of liability prior to acceptance of the prize. By accepting the prize, each winner grants to Station the right to use the winner's name, voice, picture and/or likeness for purposes of advertising and publicity in any and all media now known or hereafter invented, without further permission or additional compensation (except where prohibited by law).  All expenses on receipt and use of prize are the sole responsibility of winner.  Winners, by acceptance of their prizes, agree to release Station, CBS, Dade County Credit Union, Guillermo Perez, Attorneys at Law, Shino Bay Dermatology, and Dr. Melvin Propis and their respective advertising, promotion and production agencies from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to any prize-related activity.
•    (c) "Entrants release the sponsors, their affiliates, subsidiaries, agencies and their respective officers, employees, representatives and agents from all claims and liability relating to this promotion."

6.    Contest sponsors reserve the right to make changes in the rules of the contest which will become     effective upon announcement.
 

7.    Sponsor is not responsible for any typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of the prize.

8.    Failure to comply with the contest rules may result in a contestant's disqualification.

9.    To obtain a copy of the official rules and/or winner's list, please write by July 29, 2009.
