RULES

THE PRICE IS RIGHT MODEL SEARCH
ELIGIBILITY REQUIREMENTS

Please note: the following eligibility requirements and terms must be met in order to proceed with the application process for THE PRICE IS RIGHT MODEL SEARCH (the "Model Search").

 1. Only one application per person. 2. There will be open casting calls in selected television markets beginning July 26, 2008 through August 22, 2008, where individuals will be videotaped for consideration to be a participant in the Model Search.  3. You must be at least 18 years of age as of the date of entry to participate and be capable of portraying the role of a female Price is Right Model, including utilizing the existing show wardrobe for the current models on the Price is Right.  You will be required to show valid proof that you are at least 18 years of age at the open casting call (e.g., driver's license, birth certificate, etc.).  4. You must be legally eligible to work in the United States as of the date of entry.  5. You must not now be a candidate for public office, and if selected as a participant, you must agree not to become a candidate for public office until after the initial broadcast of all programs in which you appear.  6. You understand and agree that you may be required to pose and be photographed or videotaped while clothed, including in a bathing suit (one-piece or two-piece) if you are chosen as a semi-finalist. 7. By applying for participation in this contest, you authorize the Producers (defined below) to conduct civil, criminal, financial, driver-history and any other type of background checks deemed necessary by the Producers.  8. Employees, officers, directors and agents of CBS Corporation, FremantleMedia North America, Inc. ("Fremantle"), The Price is Right Productions, Inc. ("TPIR Prods.") (Fremantle and TPIR Prods collectively shall be referred to as "Producers"), local and national sponsors and/or of any of their respective licensees, assigns, partners, parents, affiliated and subsidiary companies and the immediate family (spouse, mother, father, sister, brother, daughter or son, regardless of where they live) or members of their same households (whether related or not) of such employees, officers, directors and agents are not eligible to be participants in the Model Search or participate in the application process.  9.  One winner will be selected in each participating television market ("semi-finalist") to receive a trip to Los Angeles on September 22-24, 2008, to audition to be a Price is Right model (the "first Los Angeles audition").  Prize includes roundtrip coach airfare from the airport closest to the participating market from which the participant was chosen, three nights hotel accommodations in a hotel selected by the Producers(room and tax only), attendance at a show taping of the Price is Right, and a welcome reception. (Approx. value is $1,800). Your schedule while in Los Angeles will be entirely at the Producers' sole discretion.  10.  During the first Los Angeles audition, five finalists may be selected to advance to the "final round" currently scheduled to take place in Los Angeles on October 6-8, 2008 (the "second Los Angeles audition").  11.  The five finalists, if chosen, will travel to Los Angeles to participate in the second Los Angeles audition, which prize will include roundtrip coach airfare from the airport closest to the participating market from which the participant was chosen, and up to four nights hotel accommodations in a hotel selected by the Producers (room and tax only) (Approx. value is $2150).  12.  One grand prize winner may be selected from among the five finalists or the semi-finalists to receive a prize that will include appearing as a model on the Price is Right for five shows on a date to be determined by Producers.  Prize will also include a trip to Los Angeles, including roundtrip coach airfare from the airport closest to the participating market from which the participant was chosen, and four nights hotel accommodations in a hotel selected by the Producers (room and tax only) (Approx. value is $4300).   13.  The grand prize winner may be chosen by the Producers, or by a public online vote.   14.   If you are selected by the Producers for the first Los Angeles audition, you must be willing to travel to Los Angeles September 22-24, 2008.  If you are selected by the Producers for the second Los Angeles audition, you must be willing to travel to Los Angeles October 6-8, 2008.  All dates and locations listed in these eligibility requirements and in the application form are subject to change in the Producers' sole discretion without notice.  15.  If you are chosen to be a semi-finalist, finalist, or grand prize winner, it is your responsibility to make any necessary arrangements with your employer and family in anticipation of your absence from home.  16.  Applicants will be chosen from across the United States for an approximate total of five to fourteen semi-finalists.  The Producers reserve the right to change any of the rules, eligibility requirements and terms, including the terms of any prizes to be awarded at any time without notice.  The Producers also reserve the right to add, cancel and/or substitute other cities as interview locations for the first-round casting calls.  17. Applications MUST be written clearly or typed and MUST be accompanied by a videotape (which we will provide) and one photograph of yourself, which must be a close-up of your face (head shot).· DEADLINE: ALL COMPLETED SUBMISSIONS MUST BE RECEIVED BY MIDNIGHT PACIFIC STANDARD TIME, SATURDAY, AUGUST 22, 2008.   18. All materials (including videotape and photos) will be retained by the Producers and become the property of the Producers and will not be returned to you whether or not you are selected as a semi-finalist or finalist. Any expenses you incur during the application process including travel costs and materials preparation (photos, etc.) are your sole responsibility. The Producers will not reimburse you for these expenses. All decisions of the Producers are final and absolute and not subject to inquiry or appeal. 19. Applications will only be considered if they are complete.
NOTE: You are not required to bring a videotape to the open call.   Complete applications that are sent to Producers shall consist of the following: 
· Completed Participant Application (including a Release and Waiver signed by you)
· One photograph of yourself, which must be a close-up of your face (head shot). 
20. Unfortunately, we will not be able to verify that we have received your application.  The Producers are not responsible for lost applications. 21. If you are selected to be a semi-finalist, you will be notified shortly before the first Los Angeles audition (if any) is scheduled to take place.  If you are selected to participate in the final selection process, you will be so advised by the Producers shortly before the second Los Angeles audition (if any) is scheduled to take place.  22. We reserve the right to make changes to the application and casting schedule. 23. The Producers reserve the right to not hold any participant applicant auditions, or to modify the manner in which it conducts such

To the best of my knowledge, (i) I do not know or have known anyone who is now, or has been in the past two years, an officer, employee, agent or representative of the CBS Corporation ("CBS"), FremantleMedia North America, Inc. ("Fremantle"), The Price is Right Productions, Inc. ("TPIR Prods.") (Fremantle and TPIR Prods collectively shall be referred to as "Producer") and/or any of their respective licensees, assignees, partners, parents, or affiliated or subsidiary companies. If I do know or have known any such person, here are the titles, jobs, and/or functions such persons have held or occupied:



I hereby acknowledge that: (i) I am at least 18 years of age or older; (ii) I understand, satisfy, and agree to be bound by, the eligibility requirements for THE PRICE IS RIGHT Model Search (the "Model Search"); (iii) I have answered and will answer all questions posed to me honestly and accurately; (iv) if any of the information that I have provided or will provide is found to be false or incomplete, it may be grounds for dismissal from the Model Search  selection process, and/or my being dismissed as a Model Search  participant, or semi-finalist or finalist, if previously selected as a semi-finalist or finalist; (v) even if I meet the eligibility requirements, the CBS Television Network (the "Network"), Producer, CBS, and/or any of their respective licensees, assignees, partners, parents, or affiliated or subsidiary companies, have no obligation to conduct any initial and/or follow-up interview with me, and/or select me as a participant, semi-finalist or finalist; (vi) even if I am selected as a participant, semi-finalist or finalist, the Producer has no obligation to complete the Model Search and the Network has no obligation to broadcast it, even if it is completed ; (vii) in the event that the show is cancelled, or not broadcast for any reason, the Producer has no obligation to award me any prizes; (viii) all of Producer's decisions concerning selection of the participants, semi-finalists, or finalists in the Model Search, the elimination of participants in the Model Search  and winners in the Model Search  are final and not subject to challenge or appeal; and (ix) the Producer shall own and shall have no obligation to return or maintain any materials submitted as part of my application, whether or not I am or am not selected as a semi-finalist or finalist.

By submitting this application, I grant to CBS, Producer and their respective agents and licensees, the right to use my name, likeness (collectively "Likeness"), photograph, recorded casting tape and biographical material (collectively, the "Materials"), in order to advertise, promote or publicize The Price Is Right, its licensee, the Model Search, or any advertisers or co-sponsors associated with the Model Search and their products and services.  I understand that by submitting this application, the taped portion of the casting call may be used as online content on a CBS website. I release Producer, the Network, CBS and/or any of their respective licensees, assigns, parents, partners, subsidiaries or affiliated entities and each of the employees, agents, officers and directors of the foregoing entities (collectively "Releasees") from any and all liability arising out of the use of my Likeness and/or the Materials.  I agree not to make any claim against Releasees as a result of the recording or use of my Likeness and/or the Materials (including, without limitation, any claim that such use invades any right of privacy and/or publicity and any claims based on defamation or libel or false light).  I understand that the Producer makes no representation that such Materials will or will not be used in any way. Any of the rights granted herein may be exercised by the Producer and their respective authorized agents, licensees, contractors, partners, successors and assigns. I understand and agree that the Network and third party beneficiaries to this agreement, and I acknowledge and agree that my performance of any obligations under this agreement is intended to benefit the Network.

CONFIDENTIALITY:

I acknowledge that in connection with my participation in the Model Search, I will acquire confidential information about the television program THE PRICE IS RIGHT (the "Program"), including trade secrets, operational methods, contestant winnings, the outcome of the episode(s) of the Program in which I may appear  and the progress and outcome of the Model Search (collectively, "Confidential Information").  I further acknowledge that any disclosure by me of Confidential Information prior to CBS' broadcast of the episode(s) in which I may appear will eliminate the suspense regarding the outcome of the episode(s) to viewers watching the Program, which will result in irreparable damage to CBS and to Producer.  Accordingly, I agree that at all times prior to the later of CBS' broadcast of the episode(s) of the Program in which I may appear, I will not, without Producer's or CBS' prior approval, disclose or discuss with anyone (including, without limitation, any media source or entity) any Confidential Information that I have obtained in connection with my participation on the Model Search.

I ACKNOWLEDGE THAT MY DISCLOSURE OF CONFIDENTIAL INFORMATION (WITHOUT PRODUCER'S OR CBS' PRIOR APPROVAL) PRIOR TO CBS' BROADCAST OF THE EPISODE(S) IN WHICH I MAY APPEAR SHALL BE A MATERIAL BREACH OF THIS AGREEMENT AND WILL RESULT IN THE FORFEITURE OF ANY PRIZES THAT I MAY HAVE WON IN CONNECTION WITH MY PARTICIPATION IN THE MODEL SEARCH.

CHOICE OF LAW:

This agreement shall be deemed to be entered into in Los Angeles County, California, and shall be governed by and interpreted in accordance with the laws of the State of California applicable to agreements executed and performed entirely within the State of California. Any action, proceeding or litigation concerning this agreement or my appearance or participation in the Program may only be brought in Los Angeles County, California, and I hereby agree that the State or Federal courts of Los Angeles County, California, shall have exclusive jurisdiction over me and the subject matter of any such proceeding.

ENTIRE AGREEMENT:
 
This agreement expresses the entire understanding between me and the Producer and replaces any and all former and contemporaneous agreements, understandings or representations between me and the Producer. No modification, alteration or amendment of this agreement will be valid or binding unless in writing and signed by both me and the Producer.

MISCELLANEOUS:
 
Without limiting the foregoing, any provision of this agreement that is invalid, illegal, or unenforceable in any jurisdiction will, as to that jurisdiction, be ineffective only to the extent of such invalidity, illegality or unenforceability, without affecting in any way the remaining provisions hereof in such jurisdiction or rendering that or any other provision of this agreement invalid, illegal or unenforceable in any other jurisdiction. Any laws that require or suggest that the interpretation of a document or agreement, or the resolution of any ambiguities contained therein, should be resolved against the drafter of the document or agreement, are hereby waived. No waiver by the Producer of any term or condition of this agreement will be construed as a waiver by the Producer of any other term or condition; nor will any waiver by the Producer of any default under this agreement be construed as a waiver by the Producer of any other default. It is further understood and agreed that no failure or delay in exercising any right, power or privilege hereunder shall operate as a waiver thereof, nor shall any single or partial exercise thereof preclude any other or further exercise thereof or the exercise of any right, power or privilege hereunder. Producer and/or the Network may freely assign, in whole or in part, any of their respective rights or obligations under this agreement. I may not assign my rights and obligations under this agreement.
